SIMONA AMERICA is part of the SIMONA AG group (Teichweg 16, D-55606 Kirn, Germany). Where your information is shared with or processed by SIMONA AG or other group companies, the group’s data-protection framework also applies (see Sections 7 and 9).
2. Scope
This policy applies to personal information we collect through this website, our contact and registration forms, our email newsletter, SIMONA Academy, our download center and customer/product tools, recruiting activities, and our official social-media pages. It does not apply to third-party websites we link to, which have their own privacy policies (see Section 14).
3. Information we collect
3.1 Information you provide to us
We collect the information you choose to give us, for example when you:
- Contact us through a form, email, or phone — typically your name, company, email address, telephone number, and the content of your message.
- Subscribe to our newsletter — your name, email address, and subscription details (see Section 8, HubSpot).
- Register for SIMONA Academy — your name, business contact details, company, and role.
- Create an account or use a customer tool, where offered — the details required to set up and service your account.
- Apply for a job — the personal and professional information in your application materials (see Section 3.4).
3.2 Information we collect automatically
When you visit the site, our servers and cookies automatically collect technical data, which may include your IP address, date/time of the request, the pages and content requested, HTTP status codes, referring URL, and browser type, version, language, and operating system. With JavaScript enabled, this may also include screen resolution and browser window characteristics. See Section 4 for cookies and analytics.
3.3 Information from third parties
We may receive information about you from our group companies, service providers (e.g., our marketing platform), and publicly available sources. For recruiting, we may review publicly accessible professional profiles (e.g., LinkedIn) consistent with applicable law.
3.4 Job applicants
If you apply for a position, we use your information to evaluate your application and make hiring decisions. We may share it internally and with affiliated companies that have a relevant opening, and we retain it only as long as needed for the application process or as required by law.
4. Cookies and similar technologies
We use cookies and similar technologies to operate the site, remember your preferences, understand how the site is used, and support our marketing.
- Strictly necessary cookies are required for the site to function and are used on the basis of our legitimate interest in providing a secure, working website.
- Analytics and marketing cookies are used only where permitted — for EU/UK visitors, with your consent through our cookie banner; for U.S. visitors, subject to the choices described in Sections 11–12.
You can manage or disable cookies in your browser settings, though some features may not work properly. You can also manage interest-based advertising through industry tools such as the Digital Advertising Alliance (aboutads.info/choices) and, in Europe, youronlinechoices.com.
We manage consent for non-essential cookies through our cookie-consent banner (Cookiebot, provided by Cybot A/S). You can review or change your choices at any time via the cookie-settings link, and a current, itemized list of the cookies we use is available in our cookie declaration.
5. How we use your information
We use personal information to:
- respond to your inquiries and provide requested information, quotes, or support;
- provide and administer accounts, SIMONA Academy, and other services you register for;
- send our newsletter and other communications you have requested, and (where permitted) relevant product and service updates;
- operate, maintain, secure, and improve our website and understand how it is used;
- carry out marketing and events consistent with your choices and applicable law;
- evaluate job applications; and
- comply with legal obligations and enforce our terms.
6. Legal bases (EEA/UK visitors)
Where the EU or UK GDPR applies, we rely on the following legal bases: performance of a contract or pre-contractual steps (e.g., servicing your inquiry or account); your consent (e.g., the newsletter and non-essential cookies), which you may withdraw at any time; our legitimate interests (e.g., securing and improving the site, and business-to-business communications), balanced against your rights; and compliance with legal obligations.
7. How we share your information
We do not sell your personal information. We share it only as follows:
- Service providers who process data on our behalf under contract — for example, hosting, our marketing/CRM platform (HubSpot), productivity and communications tools (e.g., Microsoft), and analytics providers. They may only use the data to provide services to us.
- Group companies, including SIMONA AG and other SIMONA affiliates, for the purposes described in this policy (e.g., handling your inquiry, order, or application). This may involve transfers to Germany and other countries (see Section 9).
- Legal and safety disclosures where required by law, regulation, or legal process, or to protect our rights, users, or the public.
- Business transfers, in connection with a merger, acquisition, or sale of assets, subject to appropriate safeguards.
8. Third-party services on this site
The site relies on the following third-party services. Each processes data under its own privacy terms; links are provided so you can learn more.
- Google Analytics (web analytics; Google LLC, USA). Helps us understand how visitors use the site. It runs only after you accept analytics cookies through our consent banner. Privacy policy: https://policies.google.com/privacy
- Cookiebot (consent management; Cybot A/S, Denmark). Records and stores your cookie-consent choices. Privacy policy: https://www.cookiebot.com/en/privacy-policy/
- Vimeo (embedded video; Vimeo, Inc., USA). Where we embed videos, Vimeo may set cookies and receive technical data when a video loads. Privacy policy: https://vimeo.com/privacy
- Social media pages — we maintain official pages on LinkedIn and Instagram. When you interact with these pages, the platforms process your data as controllers under their own policies. LinkedIn: https://www.linkedin.com/legal/privacy-policy · Instagram/Meta: https://www.instagram.com/about/legal/privacy/
- Email / newsletter — if you subscribe to updates, your contact details are processed by our email service provider. [CONFIRM: name the provider, e.g., HubSpot.]
9. International data transfers
We are based in the United States, and our parent company and some service providers are located in the European Union and other countries. As a result, your information may be transferred to, stored in, or accessed from countries whose data-protection laws differ from those where you live.
For transfers of EU/UK personal data to the United States or other countries, we and our group rely on appropriate safeguards, which may include the EU Standard Contractual Clauses, the EU–U.S. Data Privacy Framework (and its UK extension) where a provider is certified, and additional technical and organizational measures, consistent with the SIMONA group’s approach.
10. Data retention
We keep personal information only as long as necessary for the purposes described in this policy or as required by law (for example, tax and commercial record-keeping periods). When it is no longer needed, we delete or de-identify it. Newsletter and consent-based data are kept until you unsubscribe or withdraw consent.
11. Data security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.
12. Your privacy rights
12.1 All users
You may request access to, correction of, or deletion of your personal information, and you may unsubscribe from marketing at any time using the link in our emails or the contact details in Section 16. We will respond consistent with applicable law.
12.2 EEA / UK residents (GDPR)
If you are in the EEA or UK, you have the rights to access, rectify, erase, restrict, or object to processing, to data portability, and to withdraw consent at any time (without affecting prior processing). You also have the right to lodge a complaint with a supervisory authority. Because personal data may be processed by our parent company in Germany, you may contact the SIMONA group’s Data Protection Officer:
- Group Data Protection Officer: Ronald Baranowski, SIX DATENSCHUTZ GmbH, Kasseler Str. 30, D-61118 Bad Vilbel, Germany — rb@six-datenschutz.de · +49 6101 982 9422 · datenschutz@simona-group.com
- Lead supervisory authority (parent): Der Landesbeauftragte für den Datenschutz und die Informationsfreiheit Rheinland-Pfalz, Hintere Bleiche 34, 55116 Mainz, Germany — https://datenschutz.rlp.de
12.3 California residents (CCPA/CPRA)
If you are a California resident, you have the right to know what personal information we collect and how we use and disclose it, to request access and deletion, to correct inaccurate information, and to be free from discrimination for exercising your rights. We do not sell or “share” (as defined under California law) your personal information. To exercise your rights, contact us using Section 16.
13. Children’s privacy
This website is intended for a business audience and is not directed to children. We do not knowingly collect personal information from individuals under 16 (or under 13 in the United States). If you believe a child has provided us with personal information, please contact us and we will delete it.
14. Links to other websites
Our site may link to third-party websites (including other SIMONA group sites and partner brands such as simonapolygrain.com). We are not responsible for their content or privacy practices; please review their policies.
15. Changes to this policy
We may update this Privacy Policy from time to time. We will post the updated version here and revise the “Last updated” date above. Material changes will be highlighted as appropriate.
